Per a recent article at Product Liability Law360 (http://productliability.law360.com/Secure/ViewArticle.aspx?id=40947),
Seven plaintiffs who sued Becton Dickinson & Co. and a McKesson Corp.
subsidiary after losing at least part of their eyesight from a contaminated syringe have dismissed their product liability suit with prejudice against the companies.
The motion comes after the parties reached a settlement in early October through an alternative dispute resolution mediation. The terms of that agreement have been kept confidential. The agreement brought to an end a lawsuit initiated by nine plaintiffs in September 2006 after they suffered a virulent infection that caused them to lose part, if not all, of their eyesight after receiving a single intraocular lens implant.
The plaintiffs claimed that they would continue to suffer pain and mental anguish and incur medical expenses as a result of the infections they sustained.
