Another Medtronic Lawsuit, This One From Texas

Filed November 27th, 2007 amy

Medtronic lawsuits are popping up nationwide after Medtronic recalled its defective Sprint Fidelis defibrillator leads thus far responsible for killing five people and severely injuring many more. The latest Medtronic lawsuit was filed in Texas by Eunice Henderson and Alice Gaston of Texarkana, along with Charles Bishop of Fort Worth, per the Texarkana Gazette on November 23.

Per the Texarkana Gazette, “Henderson’s ICD was implanted during March 1998 and removed November 2006. Gaston has the same device still inside her. It was implanted in 1996. Bishop has a different model Medtronic ICD he alleges is faulty still inside his chest. It was implanted in 2003. The suit alleges Medtronic was aware of the problems with their ICDs but sold them anyway.”

Though the defective Sprint Fidelis leads were recalled in October, the leads must stay implanted unless they fracture, since it’s more dangerous to surgically remove a defective defibrillator lead than it is to leave it in the body. For many, the real damage is happening
psychologically and emotionally, as they’ve been sentenced to wait and worry that one day the defibrillators meant to save their lives will kill them.
