Bausch & Lomb and Walgreen Sued, ReNu Contact Lens Solution Recall Didn’t Happen Soon Enough

Bausch & Lomb, Inc. and Walgreen Co. are being sued by a Chicago woman who claims using the recalled contact lens solution ReNu with MoistureLoc caused an eye infection requiring medical treatment.

The plaintiff in this St. Clair County Circuit Court case claims she went through antibiotic and steroid treatment as a result of using this product and is now at risk for further injury, corneal surgery or even vision loss, without the proper treatment.

Bausch & Lomb recalled ReNu with MoistureLoc contact lens solution in 2006.  The defective product is linked to Fusarium Keratitis, a rare eye infection that can cause blindness.  Bausch & Lomb pulled the product from Asian markets in February 2006 and U.S. markets in April.  A worldwide recall was issued in May.

According to court documents in the St. Clair County case, by May 18, 2006 the Centers for Disease Control (CDC) had already received reports of 130 confirmed cases of Fusarium Keratitis infection reported from 26 states and one territory.  Because of these infections, corneal transplantation was required in 37 of those confirmed cases. Among the 130 patients with confirmed cases, 75 reported using Bausch & Lomb’s ReNu alone and 14 reported using ReNu in combination with other products.

In October, the Food and Drug Administration (FDA) issued a warning to Bausch & Lomb criticizing them for not reporting nearly three dozen infections linked to use of this product occurring before the suspension of product sales.

This St. Clair County case is only one of many potential product liability lawsuits Bausch & Lomb will face because of this contact lens solution.  Analysts predict a loss of $1 billion or more for product liability claims.
