Widow Files Lawsuit, Says Recalled St. Jude Pacemaker Killed Her Husband

A 77 year old West Virginian widow has filed suit against the physician who implanted a recalled St. Jude pacemaker into her husband causing his death.  Her husband died when the pacemaker failed.  The widow claims the physician and hospital are both negligent, since they should have known the pacemaker had been recalled before it was implanted in her husband.

Per court documents filed in the Kanawha Circuit Court case, St. Jude issued a recall notice in June of 2005 to hospitals and physicians about the model 1590-60 pacemaker warning of software problems causing the pacemakers to malfunction.  The widow is suing for compensation for her husband’s untimely death, the cost of his care and funeral costs, plus court costs and attorney fees, as well as pain and suffering.

Although her husband died two years ago, it was only a few weeks ago that she learned her husband’s pacemaker had been recalled prior to the implant.
